Langdon & Emison is still reviewing potential lawsuits on behalf of patients who suffered infections following joint replacement surgery, allegedly due to the use of the 3M Bair Hugger warming blanket. Below we answer some of the frequently asked questions regarding the 3M Bair hugger warming blanket and potential lawsuits.
What is the 3M Bair Hugger?
A Bair Hugger device is designed to keep patients warm during major surgery. It is a warming blanket that holds warm air blown through a hose. Bair Huggers have a history of successfully helping millions of surgery patients, however, the 3M Bair Hugger has been connected to adverse complications.
What adverse complications are connected to the 3M Bair Hugger?
- Post-surgical infections, including MRSA, sepsis, and deep joint infections
- High-cost treatment of post-surgical infections
- Additional surgeries
- Infections that can be serious and even lead to amputation of limbs
What is the problem with the 3M Bair Hugger?
It is alleged that the 3M Bair Hugger exposes patients to contaminated air from the operating room. The warming blanket allows air to escape from its sides into contaminated areas near the floor. The air collects bacteria and recirculates into the blanket, carrying any bacteria it may have collected. This process may make it more likely that patients develop post-surgical infections.
How has 3M responded to these allegations?
3M claims there is no scientific evidence that the 3M Bair Hugger increases the risk of surgical site infection and encourages its continued use in operating rooms.
What is the history of lawsuits against 3M regarding the Bair Hugger?
The first trial of a Bair hugger lawsuit was settled in favor of 3M, however, plaintiffs are continuing their fight. Multidistrict litigation including 4,700 plaintiffs is ongoing in a federal court in Minnesota. Additionally, in August 2021, The U.S. Court of Appeals for the Eighth Circuit overturned a 2019 decision that granted 3M summary judgment. If upheld, 3M will face allegations in court.
