Types of Personal Injury Damages
As the victim of a personal injury, you have the legal right to seek compensation for your injuries, property damage, and other kinds of losses. The kinds of compensation you may be able to recover are called “damages.”
There are two main types of personal injury damages: compensatory and punitive. Oftentimes, personal injury victims recover compensatory damages, which usually fall under general or special damages.
Special Damages
Special damages, also known as economic damages, aim to make injury victims whole for the expenses they’ve incurred due to the accident that caused their injuries. Special damages cover specific expenses such as:
- Loss of earnings
- Reduction of future earning capacity
- Hospital bills
- Prescription medication costs
- Cost of future medical care
- Household expenses
- Physical therapy, rehabilitation, and other recovery bills
- Property damage
Think of special damages as the out-of-pocket expenses that come following an accident that causes you injury. Even if two victims suffer from the same type of accident, their special damages may look drastically different from one another depending on the extent of their injuries and the treatment needed to recover.
General Damages
General damages, also known as non-economic damages, compensate injury victims for non-monetary damages resulting from their injury. Without the use of bills or invoices, general damages can be more difficult to evaluate which is where a personal injury attorney can be of service.
General damages include:
- Emotional distress
- Emotional trauma
- Physical pain and suffering
- Loss of enjoyment of life
- Loss of consortium or companionship
After you’ve sustained an injury, a personal injury lawyer at Langdon & Emison can evaluate the damages you may be entitled to recover. To schedule your free case consultation, call (866) 931-2115.

Personal Injury Frequently Asked Questions
When is it Time to Hire a St. Louis Personal Injury Attorney?
It’s never too soon to consult with an experienced personal injury lawyer. If you or a loved one have sustained an injury due to another party’s negligence, contact Langdon & Emison. Under Missouri Code §516.120, the statute of limitations for most personal injury claims is five years.
However, we advise our clients to contact us quickly after an accident so we can file the claim on their behalf as soon as possible. If you fail to file your lawsuit outside of the five years, it’s unlikely that the court will hear your case at all and you will lose your chance to recover damages needed to cover your injury-related losses.
What Does a Personal Injury Lawyer Do?
Think of your personal injury attorney as your guide, advocate, and supporter—all in one person. When you work with a personal injury attorney at Langdon & Emison, we will:
- Listen to you to gain a complete understanding of your injury, what caused it, and how it has impacted your life.
- Walk you through your different options and help you weigh the pros and cons of each potential solution.
- Always be available to speak with and be there for you.
- Conduct a thorough investigation into the cause of your accident and gather evidence to build your case.
- Negotiate on your behalf to reach a settlement that fully compensates you for your losses.
- Take your case to trial if it’s clear that the other party will not negotiate in good faith.
Lastly, a personal injury lawyer should pledge to put your interests above their own. At Langdon & Emison, we pride ourselves on our principled approach of putting clients first, always.
How Much Does it Cost to Hire a St. Louis Personal Injury Lawyer?
Our personal injury lawyers work on a contingency fee basis. This means that if we don’t win your case, you don’t pay a dime in legal fees. We only get paid if your case has reached a successful conclusion, either through settlement or a trial.
When you work with us on a contingency fee basis, you can breathe easier knowing you can focus on recovery and healing rather than worrying about how you’ll afford your legal fees.
What are Missouri’s Personal Injury Damage Caps?
Damage caps can limit the amount an injury victim can collect in a personal injury lawsuit. Damage caps vary by state, so it’s critical that you have a lawyer who is well-versed in your state’s damage cap statutes.
In 2015, Missouri placed a damage cap of $400,000 on noneconomic damages that can be recovered in medical malpractice claims or $700,000 for catastrophic injuries or death from a malpractice claim (Senate Bill 239). The bill included a 1.7% increase on the damage cap each year.
